Terms and Conditions

This document is a carefully prepared operational template for the project. Mandatory consumer and data-protection rights remain unaffected. Individual Austrian legal advice should be obtained for unusual cases or disputes.

1. Scope and provider

These terms apply to the “In the Footsteps of Great Photographers” photography and exhibition project advertised on modell.vipach.at. The contracting provider is Zentralverband Ungarischer Vereine und Organisationen in Österreich (ZVR 079797621), within which VIPACH operates.

2. Project package

The planned package includes a personalised photo shoot; 10 professionally retouched digital portraits; production of one 50 × 70 cm lenticular artwork from two selected images; participation in an approximately one-week exhibition in a Vienna gallery; invitation to the elegant champagne opening; and transfer of the lenticular artwork to the participant after the exhibition.

3. Application, selection and contract

Submitting the form is an application/request and does not itself constitute acceptance, reservation or payment obligation. A contract is formed only by an express written confirmation after selection. The confirmation states the payment deadline, payment method and final organisational details.

4. Participation contribution and value statement

The payable participation contribution is EUR 299 per person. It is a contribution to the material and production costs of the VIPACH community project. The communicated total professional and production value of EUR 1,200 is a comparative estimate, not a former selling price and not a percentage discount. No further mandatory fee applies unless an optional additional service is separately ordered in writing.

5. Scheduling and cooperation

The photo-shoot date and location are agreed individually. Participants must attend at the agreed time and provide reasonable cooperation communicated in advance. In case of substantial delay or non-attendance, a replacement appointment is subject to capacity.

6. Image selection, retouching and artistic decisions

Final selection and retouching follow the artistic concept. Retouching does not mean unlimited alteration. The lenticular print is individually manufactured through manual and machine processes; minor variations in colour, crop or alignment may be inherent in the technology.

7. Likeness and usage agreements

Image and usage terms required for the exhibition are documented in a separate model/exhibition agreement with selected participants. Advertising, press or social-media use beyond the exhibition is not automatically accepted and requires a separate legal basis or permission. The usage scope for delivered digital files is stated in the confirmation or a separate licence.

8. Withdrawal and custom production

Consumers generally have a 14-day withdrawal right for distance contracts. If a participant expressly requests that services begin during the withdrawal period, a proportionate amount may be payable for services already performed. The statutory exception for goods made to personal specifications may apply to the lenticular artwork once individual production begins. Details: withdrawal information.

9. Cancellation, changes and force majeure

The organiser may reasonably change dates, venue or an equivalent programme element where justified. If the project is permanently cancelled for reasons attributable to the organiser, amounts paid for unperformed parts are refunded. In force-majeure cases, a replacement date or equivalent solution is offered first.

10. Defects and complaints

Participants should report concerns within a reasonable time, preferably in writing to office@vipach.at. Statutory warranty rights are not limited by these terms.

11. Governing law and disputes

Austrian law applies without depriving consumers of mandatory protection under the law of their habitual residence. Jurisdiction clauses against consumers apply only where legally permitted. The organiser does not currently make a general commitment to participate in alternative dispute resolution unless required by law or agreed in an individual case.
